“Sex and the City” CONTEST

(“Contest”)

CONTEST RULES

THE FOLLOWING CONTEST IS INTENDED FOR PLAY IN CANADA ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO CANADIAN LAW. THE CONTEST IS OPEN TO LEGAL RESIDENTS OF CANADA ONLY. DO NOT ENTER THIS CONTEST IF YOU ARE NOT A LEGAL RESIDENT OF CANADA. NO PURCHASE IS NECESSARY. PARTICIPANTS MUST BE AT THE AGE OF MAJORITY IN THEIR PROVINCE OF RESIDENCE OR OLDER AT TIME OF ENTRY. VOID IN WHOLE OR PART WHERE PROHIBITED BY LAW. ENTRY IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE CONTEST RULES.

 

1.     ELIGIBILITY. To be eligible for this Contest, an individual must: (i) be a legal resident of Canada throughout the Contest Period; and (ii) have reached the age of majority in their province of residence at the time of Entry.  Employees, directors, shareholders, officers  of Coty  Inc., Alliance Films Inc., Inside Entertainment, Kontent Publishing Inc. (collectively, the "Sponsors") and the Sponsors’ respective parents, affiliates, subsidiaries, licensees, agents, any sponsor, promotional and media agencies, and any entity involved in the production, implementation, administration or fulfillment of the Contest (“Administrators”), plus immediate family members and/or persons domiciled with any of the above persons, are not eligible to participate in the Contest.

2.     DEADLINES FOR ENTRY. The Contest begins at 10:00 AM Eastern Standard Time (“E.S.T”) on April 12, 2008 and closes at 12 noon E.S.T. on May 19, 2008 (the "Contest Period").

 

3.     HOW TO ENTER. There is no purchase necessary to enter the Contest. To enter the Contest, fill out the on-line entry form located on the Contest web site at: www.insideEonline.com (“Contest Website”). Submission of a completed online entry form constitutes an “Entry” in the Contest.

 

a.     Limit of one (1) Entry per person or e-mail address, however, if you refer minimum five (5) friends you will receive five (5) additional Entries for a total of six (6) Entries.  Aside from these permitted additional Entries, multiple Entries by the same person using one or more e-mail accounts will  result in disqualification. All Entries must be submitted no later than the end of the Contest Period. All Entries become the property of the Sponsors and none will be returned. Illegible, incomplete, falsified, late or garbled Entries will be disqualified. No Entries will be accepted by any other means.

 

b.     Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of Entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. No mechanically or electronically reproduced Entries will be accepted. All Entries must be submitted from a valid email account that may be identified by reverse domain name search. All personal and other information requested by and supplied to Sponsors or Administrators for the purpose of this Contest must be truthful, complete, accurate and in no way misleading. Sponsors and Administrators reserve the right to disqualify any Entry or Entrant in its sole discretion, should any Entry or Entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information. Potential winners may be requested to provide Sponsors and proof of identification and eligibility (address and birth date) and proof that the potential winner is the authorized account holder of the email address associated with the winning Entry. Failure to provide such proof within a reasonable period of time could result in disqualification.

 

4.     PRIZES.

There is a total of ten (10) Prizes available to be won in each of the following cities:  Toronto, Ottawa, Vancouver, Calgary and Edmonton.  Each Prize consists of one (1) 50ml bottle of Lovely Eau de Toilette and one (1) 50ml Covet  Eau de Parfum, plus one (1) double pass to the advance screening of “Sex and the City” in one of the following cities: Toronto, Ottawa, Vancouver, Calgary or Edmonton.  Tickets to these advance screenings are not available to purchase, and have no retail value.  Seating is limited and not guaranteed, and times and dates of screenings may vary according to city.   Approximate retail value of each prize is $120. 00. 

 

All Prizes must be accepted as awarded and cannot be transferred, substituted or redeemed for cash,and will not be extended under any circumstances.  Any unused portion of the Prize will be forfeited.  Sponsors and Administrators reserve the right, in their sole discretion, to substitute any and all of the Prizes for prizes of equal or greater value should all or part of a Prize become unavailable for any reason.   Each winner will receive a double pass to the advance screening in one of the above five cities nearest his/her residence, and transportation to and from each screening is not included.

5.     WINNER SELECTION:

a. A random draw from all eligible Entries received will take place on or around May 19, 2008 at approximately 3:00 PM EST at Inside Entertainment in Toronto, Ontario.  Odds of winning are solely dependent upon the number of eligible Entries received. 

 

b. The selected Entrants will be notified by phone or email on the date of the draw and must respond within one (1) business day of notification.  Upon notification, and in order to be declared a winner, the selected Entrants must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered by telephone at the number provided by each Entrant on hjs/her submitted Entry form at time of Entry.  If a selected Entrant has not provided a telephone number on his/her submitted Entry, does not respond in accordance with the Contest Rules or a selected Entrant does not comply with the Contest Rules, he/she will be disqualified and will not receive a Prize and another Entrant will be selected from the remaining eligible Entries.  Sponsors or Administrators will attempt to contact the Entrant selected in any such subsequent draw within two (2) business days of such selection and such selection will be otherwise subject to the same conditions as set out in this Paragraph.  

 

c. Sponsors and Administrators are not responsible for the failure for any reason whatsoever of selected Entrant to receive notification nor for Sponsors and Administrators failure to receive selected Entrant’s response (including, but not limited to the fact that the selected entrant has a Call Privacy feature on his/her telephone service). Before being declared a winner, each selected Entrant will be required to sign an agreement and release (“Release”) confirming: (i) compliance with the Contest Rules; (ii) acceptance of the Prize as offered; (iii) releasing the Sponsors and their respective parent companies, subsidiaries, affiliates, employees, directors, officers,  suppliers, agents, sponsors and Administrators from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Contest, participation in any Prize-related activity or the acceptance, use or misuse of any Prize including, without limitation, costs injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising there from; and (iv) granting Sponsors and Administrators the unrestricted rights, in their collective or individual discretion, to publish without any further compensation the name, address, picture, portrait, photograph, likeness, voice and/or ideas of that selected Entrant in any and all forms of media for advertising and promotional purposes in relation to this Contest, and waives all rights (including moral rights) with respect to such usage. The Release must be returned within five (5) business days of the notification date indicated on the documents or the selected Entrant will be disqualified and the Prize forfeited.

 

6.     GENERAL CONDITIONS:

a.     All Entries become property of Sponsors upon receipt and will not be returned and no correspondence will be entered into except with selected Entrants.

 

b. The Sponsors and Administrators shall not bear any liability for (a) Entries which are lost, stolen, delayed, destroyed, or illegible, incomplete or otherwise improperly completed, (b) the loss, theft or misuse of the prize, or (c) any property damage, personal injury or misfortune in any way attributable to this Contest or the Prizes. 

c. Sponsors and Administrators assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries. Sponsors and Administrators are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. Sponsors and Administrators are not responsible for any injury or damage to Entrants or to any computer related to or resulting from participating or downloading materials in this Contest. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors and Administrators which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsors and Administrators reserve the right to cancel, terminate, modify or suspend the Contest, subject to the jurisdiction of the Régie des alcools, des courses et des jeux in Quebec.

 

7.     CONDUCT: By entering this Contest, Entrants agree to be bound by these Contest Rules.   Entrants further agree to be bound by the decisions of the Sponsors and Administrators, which shall be final and binding in all respects.  Sponsors and Administrators reserve the right, in its sole discretion, to disqualify any Entrant it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Contest, the Contest Website; (b) violating the Contest Rules; (c) violating the terms of service, conditions or use and/or general rules or guidelines of insideEonline.com property or service, or (d) acting in an unsportsman-like or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVES THE RIGHT TO IMMEDIATELY TERMINATE THE USER'S ACCOUNT, IF ANY, AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

 

8.     RELEASE/PRIVACY/USE OF APPLICANT INFORMATION. By entering this Contest, Entrant agrees to (a) use of Entrant's personal information by the Sponsors and Administrators for the purposes of administering the Contest and awarding Prizes; (b) execute a Release as described in the these Contest Rules; and (c) the use by Sponsors and Administrators of the Entrant’s  personal and other information, in a manner consistent with Kontent Publishing Inc. ("KPI") Privacy Policy at:

www.insideeonline.com/index.cfm/ci_id/1916.html. Entrant's personal information will be used to administer the Contest, and will not be used for any other reason nor will it be provided to any third parties, other than as provided for in these Contest Rules, however, by entering, each Entrant grants each Sponsor and Administrator the right to use his or her name and/or likeness, without further compensation, in any advertising or publicity as per Paragraph 5(c) above.

 

9.     WINNERS LIST. The names of all winners will be posted on the Contest Website.

 

10.   LAWS. These are official Contest Rules. This Contest is subject to federal, provincial and municipal laws and regulations. These Contest rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsors or Administrators.

 

11.  TERMINATION:  Sponsors and Administrators reserve the right to amend or terminate all or any portion of this Contest at any time for any reason without prior notice.
